The Central Election Commission appointed election of a deputy to the Mazhilis of the Parliament, elected by the Assembly of People of Kazakhstan instead of the one who left for April 28, 2022
On March 17, 2022, a meeting of the Central Election Commission of the Republic of Kazakhstan was held under the chairmanship of Nurlan Abdirov. The meeting was attended by Deputy Head of the Secretariat of the Assembly of People of Kazakhstan of the Presidential Administration of the Republic of Kazakhstan Leonid Prokopenko.
The following issues were considered at the meeting:
1. «On appointment of the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of People of Kazakhstan, instead of the retired one»;
2. «On approval of forms of election documents for election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of People of Kazakhstan instead of the retired one»;
3. «On establishing the amount of expenses of candidates for deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of People of Kazakhstan in the elections scheduled for April 28, 2022».
Opening the meeting, Nurlan Abdirov noted that on March 12, 2022, the Central Election Commission adopted a resolution on occurrence of grounds entailing termination of powers of the deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan Vladimir Tokhtasunov. The submission on early termination of powers of a deputy was submitted to the Mazhilis of the Parliament of the Republic of Kazakhstan. Powers of deputy V.Tokhtasunov elected by the Assembly of People of Kazakhstan were terminated ahead of schedule by the decision of the Mazhilis of the Parliament of March 14, 2022.
He also stressed that in accordance with Article 89 of the Constitutional Act "On Elections in the Republic of Kazakhstan" the basis for calling elections of deputies of the Mazhilis of Parliament is the early termination of powers of a deputy deprivation of a deputy's mandate instead of those who left or his death.
In these cases, elections of deputies instead of those who have left are appointed by the Central Election Commission no later than three months from the moment of early termination of powers of a deputy.
Based on the above the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by the Assembly of the People of Kazakhstan instead of the retired one was scheduled for April 28, 2022 by the decision of the Central Election Commission.
Deputy Chairman of the Central Election Commission Konstantin Petrov delivered a report on the first and second items on the agenda.
He noted that according to the Constitution a person who is a citizen of the Republic of Kazakhstan and has permanently resided on its territory for the last ten years can be a deputy of the Parliament. A deputy of the Mazhilis may be a person who has reached twenty-five years of age. Relevant restrictions are established by the Constitutional Act “On Elections in the Republic of Kazakhstan”.
Elections of deputies of the Mazhilis of the Parliament elected by the Assembly of People of Kazakhstan are held at the session of the Assembly of People of Kazakhstan convened by the President of the Republic. The session of the Assembly of People of Kazakhstan is attended by the chairman and members of the territorial election commission on whose territory the session is held.
The Council of the Assembly of the People of Kazakhstan shall notify the Central Election Commission about the place of voting no later than ten days before the voting day.
In premises where the session of the Assembly of People of Kazakhstan is held the election commission organizes a voting point for election of deputies of the Mazhilis of the Parliament.
The document certifying the holding of a session of the Assembly of People of Kazakhstan for election of deputies of the Mazhilis is the protocol of the session submitted to the territorial election commission.
The session is closed after the announcement of voting results on the election of deputies of the Mazhilis by the respective territorial election commission.
The results of counting of votes in the election of a deputy of the Mazhilis elected by the Assembly of People of Kazakhstan are established at a meeting of the relevant territorial election commission held at the polling station.
Based on voting results, the Territorial Electoral Commission draws up a vote count protocol for election of deputies of the Mazhilis which is announced at the session of the Assembly of People of Kazakhstan and sent to the Central Election Commission no more than two days after the election day.
At the meeting, the Central Election Commission adopted a resolution «On appointment of the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by Assembly of People of Kazakhstan instead of the retired one».
This resolution approved the calendar plan of main events for preparation and conduct of elections of the deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan scheduled for April 28, 2022 elected by the Assembly of People of Kazakhstan instead of the retired one.
According to the calendar plan the following stages of the election campaign are defined:
Nomination of candidates shall take place from March 29 to 18.00 April 7 this year (begins one month and ends at eighteen o'clock local time twenty days before the election).
The nomination of candidates for deputies of the Mazhilis of the Parliament elected by the Assembly of People of Kazakhstan is carried out by the Council of the Assembly. The decision of the Council of the Assembly of People of Kazakhstan is adopted by a majority of votes and is documented as an extract from the minutes. The decision of the Council of the Assembly of People of Kazakhstan is sent to the Central Election Commission together with the citizen's statement of consent to run.
Registration shall take place from April 8 to 18.00 April 12 this year (registration of candidates nominated by Council of the Assembly of People of Kazakhstan begins twenty days in advance and ends at eighteen hours local time fifteen days before the election).
Registration of candidate nominated by the Council of the Assembly of People of Kazakhstan is carried out by the Central Election Commission in presence of an extract from protocol of the Council of Assembly on nomination of candidates; statements of a citizen about his consent to run as a candidate for deputies; biographical data on each person nominated by the Council of the Assembly of People of Kazakhstan; certificates of state revenue authority on submission by candidate nominated by Council of the Assembly of People of Kazakhstan and his (her) spouse (husband) of declarations of assets and liabilities.
The accuracy of information about assets and liabilities declared by the candidate nominated by the Council of the Assembly of People of Kazakhstan and his (her) spouse (husband) is checked by state revenue authorities within three days from the date of registration of the candidate.
Election campaign will take place after 18.00 on April 12 until 12 a.m April 27 this year (starts from the end of the candidate registration period and ends at 12 a.m local time on the day preceding election day).
● Day of Silence – April 27 this year.
● Voting day – April 28 this year.
The results of election of a deputy to the Mazhilis of the Parliament are established by the Central Election Commission of the Republic of Kazakhstan no later than seven days from the date of the elections - no later than May 4 of this year and publishes in the media a message about the election results.
On the second question, Konstantin Petrov noted that the Central Election Commission establishes the form and text of the voting ballot for the election of deputies of the Mazhilis of the Parliament within its powers and also ensures their production.
In this regard, the meeting adopted a resolution «On establishing forms of election documents for the election of a deputy of the Mazhilis of the Parliament of the Republic of Kazakhstan,elected by the Assembly of People of Kazakhstan instead of the retired one appointed for April 28, 2022».
The resolution approved 9 forms of electoral documents for the election of a deputy of the Mazhilis of the Parliament elected by the Assembly of People of Kazakhstan instead of the retired one.
Member of the Central Election Commission Sabila Mustafina made a report on the third issue of the meeting. She said that in accordance with the electoral law the state guarantees candidates equal allocation of funds to speak with their programs in the media. The procedure and volumes of allocation of funds for speeches in media to candidates are determined by the Central Election Commission.
According to the resolution of the Central Election Commission “On approval of Rules and volumes of allocation of funds to candidates for speaking in the media” dated August 25, 2018 No. 12/202 funds are allocated for a candidate to speak with his programs in the media: on television - 15 minutes; on the radio - 10 minutes; for publications in printed periodicals or online publications of two articles no more than 0.1 printed sheet.
According to the Constitutional Act “On Elections in the Republic of Kazakhstan” the republican budget also covers the expenses of candidates for holding public pre-election events; release of campaign materials; transportation expenses in amounts established by the Central Electoral Commission.
In connection with the above, the Central Election Commission adopted a resolution «On establishing amount of expenses of candidates for deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan elected by Assembly of People of Kazakhstan in elections scheduled for April 28, 2022».
The resolution establishes amount of the candidate's expenses for: speaking with programs on television and radio as well as publishing 2 articles in print periodicals in the amount of 590,000 tenge; holding public pre-election events and issuing campaign materials in the amount of 130,000 tenge; transportation costs - in the amount of 150,000 tenge.
