Refusal to register Zhumatai Aliyev as a candidate for the President of the Republic of Kazakhstan
On May 2, 2019, a meeting of the Central Election Commission of the Republic of Kazakhstan was held, attended by representatives of political parties and a number of state authorities. The meeting addressed a draft Resolution:
1. Refusal to register Zhumatai Aliyev as a candidate for the President of the Republic of Kazakhstan
A member of the Central Election Commission of the Republic of Kazakhstan, Lyazzat Suleimen, presented a report on the draft Resolution.
On April 28, 2019, the documents of Zhumatai Aliyev on his nomination as a candidate for the President of the Republic of Kazakhstan from the Public Association “Khalyk Demographyyasy” were submitted to the Central Election Commission. In accordance with clause 2 of Article 54 and Article 55 of the Constitutional Act on Elections, the following documents were submitted:
1) Extract from the protocol of the meeting of the highest body of the Public Association “Khalyk Demographyyasy” on the nomination of Zhumatai Aliyev for the President of the Republic of Kazakhstan;
2) The statement by Zhumatai Aliyev about his consent to run as a candidate for the President of the Republic of Kazakhstan with the attachment of his biographical data, a copy of the identity document, a copy of the higher education diploma, documents confirming experience in the public service or in elective government positions.
3) A document certifying the payment of the election contribution to the account of the Central Election Commission;
Requests were sent to the authorized state bodies to assist in verifying the compliance of candidate for the Presidency of the Republic of Kazakhstan Zhumatai Aliyev with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan "On Elections in the Republic of Kazakhstan", and the relevant information was received. This information was received from the following authorities:
- Migration Service Committee of the Ministry of Internal Affairs of the Republic of Kazakhstan;
- Committee on Legal Statistics and Special Records of the Prosecutor General's Office;
- Agency for Civil Service Affairs and Anti-Corruption of the Republic of Kazakhstan.
On May 2, 2019, a meeting of the linguistic commission to establish fluency of Zhumatai Aliyev in the state language was held at the Central Election Commission of the Republic of Kazakhstan.
According to the results of the examination, the linguistic commission decided that the candidate for the Presidency of the Republic of Kazakhstan, Zhumatai Aliyev, is not fluent in the state language (protocol No. 9 of the meeting of May 2, 2019).
Taking into account the non-proficiency of Zhumatai Aliyev in the state language established following the examination, a protocol was adopted on his non-compliance with the requirements set for the presidential candidate in accordance with the Constitution and the Constitutional Act on Elections.
In this regard, the draft resolution of the Central Election Commission was prepared and adopted.
According to the first clause of this Resolution, the candidate for the President of the Republic of Kazakhstan, Zhumatai Aliyev, does not comply with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act “On Elections in the Republic of Kazakhstan”.
The second clause of the Resolution provides for the refusal of Zhumatai Aliyev to register as a candidate for the President of the Republic of Kazakhstan.
