In all lasting from the beginning of the electioneering period by the Central election commission were received 138 appeals. 48 of them were received from July, 27th till August, 2d.
14 of the received appeals are on the violations in the organization of election of the deputies of Mazhilis of the Parliament. In particular 8 appeals are on the violation of the Rules of holding the electioneering, 3 on the violation in the work of the election commissions and 3 more on the violation in the work of the governmental bodies.
Besides 12 of the received appeals are on the violations in the organization of election of the deputies of Maslikhats and 13 more appeals contain requests on explanation of the norms and positions of the election legislation.
As of August, 4th by the Central election commission were considered 125 appeals and applications of the citizens and organizations.
The materials of consideration of 5 complaints are submitted for consideration to the governmental bodies: 4 – to the Prosecutor’s office, 1 – to the Ministry of Home Affairs.
One appeal is submitted to Akmola election commission for given the answer to the applicant, three more to the election commission of the city of Astana.
On July, 30th 2007 the Central election commission of the Republic of Kazakhstan received the application of the candidate for the deputies of Mazhilis of the Parliament of the Republic of Kazakhstan the Chairman of RPA “National Social Democratic Party” Z. A. Tuyakbai on the violation of his election rights and the rights of National Social Democratic Party for the electioneering.
According to the official written explanations given by the administration of the newspaper “Kazakhstanskaya Pravda” by the Application the text of the interview with Z. A. Tuyakbai was submitted to the electronic address of the newspaper “Kazakhstanskaya Pravda” on July, 26th 2007 at 17.03 that is several hours before putting the number of the newspaper in printing.
Earlier on June, 30th 2007 by the newspaper “Kazakhstanskaya Pravda” was published an information announcement about the fees, conditions and order for print space which provides the necessity of submission of the campaign materials to the editors of the newspaper 3 days before the planed day of publication.
Thus for publishing the interview on July, 27th 2007 it was necessary to submit it to the advertisement department of the newspaper not later than July, 24th.
Because of non-compliance of these conditions the interview was published not the day approved by the minutes on casting of lots but the next day – on July, 28th 2007.
However in this case may have been a violation of the Law of the Republic of Kazakhstan “on the mass media” the materials were submitted by the Central election commission to the General Prosecutor’s Office of the Republic of Kazakhstan for their consideration and taking measures.
On August, 4th by the General Prosecutor’s Office to the administration of the newspaper “Kazakhstanskaya Pravda” were explained the norms of the legislation and to avoid legal consequences was suggested to ensure strict compliance with the Constitution and Laws of the Republic of Kazakhstan.
Also on July, 30th 2007 to the Central election commission submitted the application of the Head of the Central pre-election staff of RPA NSDP O. A. Zhandosov which contains the request to withdraw from the Almaty territorial election commission A. M. Zhunusov who is a dean of the Law faculty in the Abai Kazakh National Teacher training University. The reason for the application was that the rector of the Abai KNTU T. S. Sadykov is registered as the candidate for the deputies of Mazhilis on the list of NDP “Nur Otan” and according to paragraph 12 article 20 of the Law on Elections the persons in the direct subordination of the candidates can’t be the member of the election commissions realizing the direct organization and holding in the election okrug th elections in which is participated the candidate.
The Central election commission considered with this application. According to the submitted to the Central election commission materials T. S. Sadykov from July, 18th 2007 is in the ordinary working vocation, and A. M. Zhunusov himself is in his working vocation since 2d day of the same month and his duty is assigned to vice-dean of the faculty.
Besides at election of the deputies of Mazhilis of the Parliament the common okrug is the whole republic and therefore the immediate organization of these elections is realized by the Central election commission.
