On 5 February 2011 nomination of candidates at early election of the President of the Republic of Kazakhstan appointed on 3 April 2011 has started
On Saturday, 5 February according to the Calendar plan approved by the Central Election Commission nomination of candidates has started. On the same day Mr. Salim Sagyndykuly Oten has submitted to the Central Election Commission an application to nominate his candidature in the order of self-nomination, and on 6 February Mr. Ualikhan Abishevich Kaysarov has nominated his candidature in the order of self-nomination. On 7 February Mr. Musagali Sarsembayuly Duambekov has also nominated his candidature in the order of self-nomination. Thus, at present during electoral campaign three candidates to President of the Republic of Kazakhstan have been nominated. Two of them had nominated their candidatures previously at electoral campaign on election of President of the Republic of Kazakhstan in 2005.
The right to nominate candidates to President belongs to republican public associations as well as to citizens through self-nomination.
Candidates to President are nominated by republican public associations on behalf of their superior bodies. The law does not oblige public associations to nominate only their members.
Self-nomination of candidate to President is carried out by submission of corresponding application to the Central Election Commission.
According to clause 2 of Article 54 of election law the compliance of candidate to President to the requirements stipulated by the Constitution and Constitutional Act “On elections in the Republic of Kazakhstan” shall be established by Central Election Commission within five days from the day of submission of all necessary documents.
The fact of residence of a candidate to President at least fifteen years in the Republic of Kazakhstan shall be established by Central Election Commission based on the data submitted by Ministry of Justice and Ministry of Internal Affairs of the Republic of Kazakhstan, and the procedure for establishment of fluent knowledge by a candidate of the state language shall be determined by the resolution of the CEC in accordance with the Act of the Constitutional Council on official interpretation of clause 2 of Article 41 of the Constitution. This Act stipulates that the norm “fluent in the state language” shall be understood as the ability to read correctly, to write, to express his/her thoughts easily and without difficulties and to speak in public in the Kazakh language.
On 7 February the Central Election Commission has amended the resolution “On formation of linguistic commission on the establishment of fluent knowledge of the state language by a candidate to President of the Republic of Kazakhstan”, adopted on 31 August 2005, by approval of its new membership.
The procedure of establishment of the fluent knowledge of the state language by a candidate to President of the Republic of Kazakhstan has not been changed and is determined by the resolution of the CEC “On procedure for establishment of fluent knowledge of the state language by a candidate to President of the Republic of Kazakhstan” of 31 August 2005.
To establish the fluent knowledge of the state language it shall be required:
1) writing a written task on the topic proposed by linguistic commission of not more than two pages;
2) reading the printed text proposed by linguistic commission of not more than three pages;
3) public statement on a topic proposed by linguistic commission of not more than fifteen minutes.
Except members of linguistic commission and a candidate to President of the Republic of Kazakhstan the meeting of linguistic commission is visited by a member of the Central Election Commission of the Republic of Kazakhstan as an observer.
Decision of linguistic commission shall be taken by open vote by majority of commission’s members and shall be drawn up in the minutes.
Decision of linguistic commission shall be immediately given to member of the Central Election Commission of the Republic of Kazakhstan who is present at the meeting of the commission.
After establishment of compliance of nominated candidates to the requirements of the Constitution and Constitutional Act on elections the CEC within five days shall be obliged to issue them subscription lists for the collection of citizens’ signatures.
According to the adopted by CEC resolution the number of authentic signatures in support of a candidate to President of the Republic of Kazakhstan shall be not less than 91 thousand and 10. Collection of signatures in support of a candidate to President shall be carried out by proxies. Number of groups to collect signatures and number of members of these groups are not limited.
Taking into account the possibility of spoiled subscription lists and their loss the CEC will produce and provide each candidate with subscription lists in the amount of not less than 5 000 copies per 100 000 signatures of voters. If necessary additional subscription lists shall be issued.
Filled in subscription lists in support of a candidate to President shall be submitted to the territorial election commissions, which within ten days shall check the authenticity of signatures with involvement of employees of passport offices, compile the corresponding protocol and send it to the Central Election Commission.
Check of authenticity of signatures shall be carried out before establishment of authentic signatures till the amount, which is necessary to a candidate to President, i.e. in case of confirmation of authenticity of 91 thousand and 10 signatures of citizens the check of other signatures shall not be carried out.
CEC also determined that special temporary accounts of election funds of registered candidates to President shall be opened and kept in JSC “People’s Savings Bank of Kazakhstan”, which has the most developed network of brunch offices in the Republic.
The fourth resolution of CEC determines that at early election of the President of the Republic of Kazakhstan representatives of foreign mass media shall be eligible to monitor elections upon submission of accreditation card, issued by the Ministry of Foreign Affairs of the Republic of Kazakhstan. International observer and representative of foreign mass media can be accompanied by an interpreter, who must present a document identifying him/her.
In addition the text of application form of international observer is approved by this resolution adopted, which established that accreditation of international observers will be conducted from 7 February till 28 March 2011.
After the meeting of CEC there was the first meeting of the linguistic commission. Its work shall be carried out publicly and transparently. Mass media will have opportunity to observe the beginning of procedures to establish fluent knowledge of the state language and the whole process of decision-making by the linguistic commission in respect to each candidate.
