The Central Election Commission approved the conclusion on application of official reprimand measures towards the Deputy of the Senate of the Parliament of the Republic of Kazakhstan Z.K. Battalova.
     
     Upon consideration of the Address made by the Senate of the Parliament based on request of the General Prosecutor’s Office of the Republic of Kazakhstan dated 26 October 2005 as well as supporting documents and video recording, on 31 October 2005 the Central Election Commission of the Republic of Kazakhstan considered granting Senate‘s approval for application of official reprimand measures according to the procedure established by the Court towards the Deputy of the Senate of the Parliament of the Republic of Kazakhstan Z.K. Battalova to be possible.      The reasons for drawing abovementioned conclusion were that Z.K. Battalova along with other individuals have held an unsanctioned meeting on 8 October 2005 in Almaty City, which constituted grounds for liability as provided for by the Article 373 of the Code of the Republic of Kazakhstan on administrative offences.
     Deputy Battalova and other organizers portrayed this event as the meeting of the Senate Deputy with the Almaty City residents.
     Item 3 of the Article 30 of the Constitutional Law of the Republic of Kazakhstan “ On Parliament of the Republic of Kazakhstan and status of its deputies” provides that in order to foster the relationship between the Parliament Deputes and their electorate and systematically inform them about the activities of the Parliament , execution of requests of the Parliament, its Houses and their bodies, everyone shall be granted the right to have visiting missions in the election districts. Due to the fact that Z.K. Battalova was elected the Deputy from East Kazakhstan region, the event organized by her in Almaty cannot be regarded as meeting with the electorate.
     In fact, in reply to request for holding a meeting on 8 October 2005 dedicated to the themes such as “Freedom for G.Zhakiyanov”, “Freedom of press” to be held in Astana Square of Almaty City (Old Square) made on 28 September 2005 by B. Abilov and T.I. Tohtasynov , the permission for holding this meeting on 8 October 2005 in the square behind the Sary Arka movie theatre was granted by Almaty City Akimat.
     Despite this, organizers of the meeting ignored the provisions of the Law and the Resolution of the Akimat of Almaty City.
     According to the declared agenda of the meeting-«Freedom for G.Zhakiyanov”, “Freedom of press” , it is a form for expression of public, group or individual interests or protest, defined in the legislation as gatherings, meetings, processions and demonstrations. That is why this event should have been organized and held on the basis of provisions of the Law of the Republic of Kazakhstan «On procedure for organization and holding of peaceful gatherings ,meetings, processions, pickets and demonstrations in the Republic of Kazakhstan”.
