On October 24, 2005 the registration of the candidates for the Presidency in the Republic of Kazakhstan will be accomplished. Pre-election campaign, one of the most important and critical stages of the election campaign of the President of the Republic of Kazakhstan, begins on October 25.

The Central Election Commission considers necessary to remind all participants of the election campaign of the following provisions of the Constitutional Law on Elections in the Republic of Kazakhstan:

The pre-election campaign is implemented :

Through mass media;

By conducting public pre-election actions (pre-election meetings and meetings with voters (electors), public pre-election debates and discussions, meetings, processions, demonstrations and other pre-election actions in the order established by the legislation and not forbidden by the Constitutional Law On Elections in the Republic of Kazakhstan, personal meetings of candidates and their proxies with voters (electors);

Through issue and (or) distribution of printed, audiovisual and other propaganda materials .

It is forbidden to conduct a pre-election campaign, to distribute any propaganda pre-election materials :

To the state bodies, bodies of local governments as well as their officials in duty status;

To the armed forces personnel, other troops and military formations, personnel of the national security agencies, law-enforcement agencies and judges;

To members of election commissions;

To religious associations.

      Mass media is obligated to cover impartially the candidates’ election campaign. It is strictly prohibited to publish agitation materials and other information deliberately discrediting honor, dignity and business reputation of any registered candidate .

The Central Election Commission believes that the mass media’s Charter For Pure Elections will promote to follow these requirements .

Conducting of the pre-election campaign accompanied by granting to voters of goods, services, securities free of charge or on favorable terms as well as conducting lotteries, charitable actions, payment of money or promise to provide the latter shall be considered as an improper pre-election campaign, except for free distribution of the printed and illustrative materials, badges, flags and the tags specially produced for the election campaign. It is forbidden to conduct improper pre-election campaign .

The candidates as well as any individuals and legal persons acting on behalf of them or in their support are forbidden to conduct charitable actions except for organization of entertainment and sports events since the moment of the elections announcement.

Any candidate’s election program must not declare the ideas of violent change of the Constitutional system, the Republic’s integrity breach, the State security detriment, stirring up the social, racial, national, religious, class and tribal disagreement, cult of cruelty and violence.

Meetings, rallies and demonstrations, processions and picketing should be conducted in accordance with the requirements of the Law of the Republic of Kazakhstan dated March 17, 1995 On Procedures of Peaceful Meetings, Rallies, Processions, Pickets and Demonstrations Organization and Conducting in the Republic of Kazakhstan. The Central Election Commission in its statement dated October 11, 2005 emphasized that the governmental agencies should ensure the freedom to conduct legal, non-violent meetings and give permissions to conducting meetings in the same places, in different time and on different days without discrimination with respect to both current leadership of the country and other candidates for the Presidency.

However it is necessary to stress that conducting of unapproved meetings, rallies, processions, pickets and demonstrations is prohibited by the law.

The agitation printed materials are displayed in the previously defined places equipped with stands, boards and curbstones by the terms ensuring equal rights for all candidates.

All agitation printed materials should contain the information on the organization issued these materials, printing place and circulation as well as on the customers and the source of financing. It is prohibited to produce agitation printed materials beyond the territory of the Republic of Kazakhstan as well as to distribute anonymous agitation materials .

It is prohibited to fund election campaign of the candidates for the Presidency in the Republic of Kazakhstan by international organizations and public associations, foreign governmental agencies, foreign legal persons and citizens. The candidates’ election funds are subject to the state registration and are restricted by the limit amount of funds.

Authorized state agencies are obligated to take all measures to prevent illegal actions ensuring thereby public tranquility and loyalty.

The Central Election Commission states that the breach of the law requirements will result in responsibility of the election process members including denial of registration or cancel of decision to register the candidate for the Presidency in the Republic of Kazakhstan.
