Meeting of the Central Election Commission of the Republic of Kazakhstan of April 26, 2019
On April 26, 2019, a meeting of the Central Election Commission of the Republic of Kazakhstan was held, attended by representatives of political parties and a number of state authorities. The meeting addressed the following issues:
Establishing the compliance of the candidate for the President of the Republic of Kazakhstan Sadi-Bek Tugel with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”.
2. Calling the election of a member of the Senate of the Parliament of the Republic of Kazakhstan from the city of Shymkent for June 24, 2019 instead of the member leaving.
Resolutions have been passed on these two issues:
1. “Establishing the compliance of the candidate for the President of the Republic of Kazakhstan Sadi-Bek Tugel with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”
A member of the Central Election Commission, Bakhyt Meldeshov, informed that on April 22, 2019, the relevant documents of Sadi-Bek Tugel on his nomination as a candidate for the President of the Republic of Kazakhstan from the Republican Public Association “Uly Dala Kyrandary social and cultural movement” were submitted to the Central Election Commission of the Republic of Kazakhstan in accordance with Article 55 of the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”:
1. Extract from the protocol of the meeting of the highest body of the Republican Public Association “Uly Dala Kyrandary social and cultural movement” on the nomination of Sadi-Bek Tugel for the President of the Republic of Kazakhstan;
2. A document certifying the payment of the election contribution to the account of the Central Election Commission of the Republic of Kazakhstan;
3. The statement by Sadi-Bek Tugel about his consent to run as a candidate for the President of the Republic of Kazakhstan with the attachment of his biographical data, a copy of the identity document, a copy of the higher education diploma, documents confirming experience in the public service or in elective government positions.
The Central Election Commission sent requests to the authorized state bodies to assist in verifying the compliance of candidate for the Presidency of the Republic of Kazakhstan Sadi-Bek Tugel with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan "On elections in the Republic of Kazakhstan", and the relevant information was received.
On April 24, 2019, a meeting of the linguistic commission to establish fluency of Sadі-Bek Tugel in the state language was held at the Central Election Commission of the Republic of Kazakhstan. The linguistic examination was carried out in accordance with all the established stages.
According to the results of the examination, the linguistic commission decided that the candidate for the Presidency of the Republic of Kazakhstan, Sadi-Bek Tugel, is fluent in the state language (protocol No. 3 of the meeting of April 24, 2019).
The Central Election Commission has found that Sadi-Bek Tugel:
1) Based on information from the Migration Service Committee of the Ministry of Internal Affairs, is a citizen of the Republic of Kazakhstan by birth, who has been living in Kazakhstan for the last fifteen years;
2) has higher education;
3) on the basis of information from the Committee on Legal Statistics and Special Records of the Prosecutor General's Office:
- he has no criminal record;
- he has not been found guilty of committing corruption crime or offense;
- he has the right to vote;
4) Based on information from the Agency for Civil Service Affairs and Anti-Corruption, he has experience in public service, as well as in elective government positions, which is at least 5 years.
Clause 1 of the Resolution establishes that candidate for the Presidency of the Republic of Kazakhstan Sadі-Bek Tugel meets with the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”.
Clause 2 of the Resolution instructs election commissions of oblasts, cities of republican significance, the capital of the Republic of Kazakhstan to issue to Sadі-Bek Tugel the signature sheets for collecting signatures in support of the candidate for the President of the Republic of Kazakhstan.
The collection of signatures is carried out by proxies of the presidential candidate and is documented by signature sheets.
The registration of proxies is carried out by the territorial election commissions on the basis of the Instruction approved by the CEC Resolution No. 62/108 of November 21, 2011.
2. Calling the election of a member of the Senate of the Parliament of the Republic of Kazakhstan from the city of Shymkent for June 24, 2019 instead of the member leaving.
The draft resolution was presented by Deputy Chairman of the Central Election Commission, Konstantin Petrov.
By the Decree of the President of the Republic of Kazakhstan dated March 18, 2019, Darkhan Satybaldy, who held an elected position of the member of the Senate of Parliament, was appointed Ambassador Extraordinary and Plenipotentiary to the Republic of Uzbekistan.
On March 19, 2019, the Central Election Commission adopted a resolution on the termination of the authority of D. Satybaldy as a member to the Senate.
According to the Constitutional Act “On Elections in the Republic of Kazakhstan”, the early termination of the authority of the member is the basis for calling the election of a member instead of the leaving member. At the same time, the elections are scheduled by the Central Election Commission not later than two months from the date of early termination of powers.
In accordance with this, a resolution was adopted by the Central Election Commission to call the election of a member to the Senate of the Parliament of the Republic of Kazakhstan from the city of Shymkent for June 24, 2019, as well as a Calendar Plan of the main activities for the preparation and conduct of elections of the member of the Senate of the Parliament of the Republic of Kazakhstan from the city of Shymkent was approved.
The Calendar Plan was drawn up in accordance with the terms established by the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan” for the election campaign.
The nomination begins from the day following the day of calling the elections – starts on April 27 and ends on May 24, 2019.
The nomination of candidates for a member of the Senate shall be carried out:
1) at a session of maslikhat of a city of republican significance.
Political parties and other public associations propose candidates for the member of the Senate of the Parliament of the Republic of Kazakhstan through their representatives in maslikhats.
2) through the procedure of self-nomination.
A member of the maslikhat, as well as a citizen residing in the territory of the relevant city of republican significance, may be nominated for the Senate.
A member of the Senate of Parliament may be a citizen of Kazakhstan who is at least 30 years old, who has a higher education and work experience of at least five years, as well as permanently residing at least three years in the region he/she represents.
The registration of candidates begins after receipt of all necessary documents and ends at 6 pm twenty days before the election day, June 3. To register as a candidate for a member of the Senate of Parliament, applicants need to get the support of a certain number of electors - members of the Maslikhat of the city of Shymkent.
The election campaign will begin after 6:00 pm on June 3 and end on June 22, 2019. Candidates for a member of the Senate of Parliament will be provided with funds from the national budget for the election campaign.
The Calendar Plan also envisages a timeframe of the electoral procedures for conducting election meetings and vote counting.
Following the extended meeting, a briefing was held at the Central Election Commission with the participation of media representatives, where members of the CEC of the Republic of Kazakhstan answered all the questions from the media.
