The Central Election Commission adopted a resolution on the compliance of candidate for the President of the Republic of Kazakhstan Kassym-Zhomart Tokayev
On April 25, 2019, the Central Election Commission adopted a resolution on the compliance of candidate for the President of the Republic of Kazakhstan Kassym-Zhomart Tokayev with the requirements of the Constitution and the Constitutional Act "On Elections in the Republic of Kazakhstan".
On April 23, 2019, the documents of Kassym-Zhomart Tokayev on his nomination as a candidate for the President of the Republic of Kazakhstan from the Public Association “Nur Otan Party” were submitted to the Central Election Commission of the Republic of Kazakhstan in accordance with Article 55 of the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”:
1. Extract from the protocol of the meeting of the highest body of the Public Association “Nur Otan Party” on the nomination for the President of the Republic of Kazakhstan;
2. A document certifying the payment of the election contribution to the account of the Central Election Commission of the Republic of Kazakhstan;
3. The statement by Kassym-Zhomart Tokayev about his consent to run as a candidate for President of the Republic of Kazakhstan with the attachment of biographical data, a copy of the identity document, a copy of the higher education diploma, documents confirming experience in the public service or in elective government positions.
On the same day, a meeting of the linguistic commission to establish fluency in the state language of Kassym-Zhomart Kemeluly Tokayev was held at the Central Election Commission of the Republic of Kazakhstan. The linguistic examination was carried out in accordance with all the established stages.
According to the results of the examination held by the linguistic commission, it was decided that candidate for the Presidency of the Republic of Kazakhstan Kassym-Zhomart Tokayev fluently speaks the state language (protocol No. 2 of the meeting as of April 23, 2019).
The Central Election Commission sent requests to the authorized state bodies to assist in verifying the compliance of the candidate for President of the Republic of Kazakhstan, Kassym-Zhomart Tokayev, with the requirements established by the Constitution and the Constitutional Act “On Elections in the Republic of Kazakhstan”, and relevant information was received.
The Central Election Commission has found that Kassym-Zhomart Tokayev:
1) Based on information from the Migration Service Committee of the Ministry of the Internal Affairs, is a citizen of the Republic of Kazakhstan by birth, who has been living in Kazakhstan for the last fifteen years. According to the regulatory resolution No. 4 of the Constitutional Council of April 25, 2019 “On the official interpretation of clause 2 of Article 41 of the Constitution of the Republic of Kazakhstan”, he complies with clause 2 of Article 41 of the Constitution of the Republic of Kazakhstan regarding residence in Kazakhstan for the last fifteen years;
2) has higher education;
3) on the basis of information from the Committee on Legal Statistics and Special Records of the Prosecutor General's Office:
- he has no a prior conviction, which has not been cancelled or withdrawn in the order established by the legislation;
- he has not been found guilty of committing corruption crime or offense;
- he has the right to vote;
4) Based on information from the Agency for Civil Service Affairs and Anti-Corruption, he has experience in public service, as well as in elective government positions, which is at least 5 years.
Clause 1 of this Resolution establishes that candidate for Presidency of the Republic of Kazakhstan Kassym-Zhomart Tokayev meets the requirements of the Constitution of the Republic of Kazakhstan and the Constitutional Act of the Republic of Kazakhstan “On Elections in the Republic of Kazakhstan”.
Clause 2 of this Resolution instructs the election commissions of regions, cities of republican significance, the capital of the Republic of Kazakhstan to issue to Kassym-Zhomart Tokayev the signature sheets for collecting signatures in support of the candidate for the President of the Republic of Kazakhstan.
The collection of signatures will be carried out by proxies of the candidate. The registration of proxies will be executed by territorial election commissions on the basis of the Instruction approved by the CEC Resolution No. 62/108 of November 21, 2011.
Following the extended meeting, a briefing was held at the Central Election Commission with the participation of media representatives, where members of the CEC of the Republic of Kazakhstan answered all the questions from the media.
