Zhamalov on the facts set out in the article “Successful" deputy Zhamalov may leave the Parliament of Kazakhstan”, published on the Internet portal www.365info.kz on 17 January 2017”
Article 52 of the Constitution prohibits a deputy to be engaged in the business activities. In case of violation of the requirements the consideration of issues related to the application of disciplinary measures to a deputy shall be assigned to the Central Election Commission of the Republic of Kazakhstan.
On 18 January 2017 at the session of the Central Election Commission the examination of facts of the article “Successful” deputy Zhamalov may leave the Parliament of Kazakhstan”, published on 17 January 2017 on the Internet portal 365.info.kz was initiated.
Present at the session of the CEC deputy A.M. Zhamalov explained that in accordance with the requirements of the legislation he transferred his “Property Assessment Center” LLP and “Gaukhar” LLP in trust and submitted the corresponding documents.
Guided by the provisions of the Constitution, the Constitutional Act “On Parliament and the status of its deputies” as well as of the Statute on the Central Election Commission, the CEC has set up the commission on examination of this fact and sent the corresponding official requests to the Ministry of Justice of the Republic of Kazakhstan, trust managers of “Property Assessment Center” LLP and “Non-state pawnshop “Gaukhar” LLP Mr. E.E. Umarov and Ms. N.K. Yelaeva, the Notary of Uralsk city Ms. R.M. Mansurova, who confirmed the transfer of property in trust.
The examination was done by members of the commission in full. Member of the Central Election Commission Mr. M.A. Sarsembayev reported on the results of examination at the CEC session.
The information obtained from primary sources confirmed that the necessary and established by legislation actions regarding transfer of property in trust by deputy A.M. Zhamalov were done timely and in compliance with the law.
Based on the submitted documents and the provisions of Kazakh legislation on the incapability of entrepreneurial and deputy activities, the CEC has concluded that deputy of the Mazhilis of Parliament of the Republic of Kazakhstan Mr. Amanzhan Makarimuly Zhamalov has not violated the requirements of clause 3 of Article 52 of the Constitution of the Republic of Kazakhstan.
